Welcome to Adomatix (“Company”, “we”, “our”, or “us”), owned and operated by OXYWEBS LLP. These Terms of Service (“Terms”) govern your access to and use of our website adomatix.com, platform, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Services. By using the Services, you represent and warrant that you meet these requirements.

2. Account Registration

  • Provide accurate, complete, and current information during signup and maintain it thereafter.
  • Maintain the confidentiality of your credentials and restrict access to your account.
  • You are responsible for all activities that occur under your account.

3. Acceptable Use

When using the Services, you agree not to:

  • Engage in unlawful, deceptive, or fraudulent activity.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Reverse engineer, decompile, or attempt to derive source code from the Services.
  • Upload malware, harmful code, or unauthorized tracking scripts.

4. Subscriptions, Billing & Payments

  • Paid plans, pricing, and features are listed on adomatix.com and may change with prior notice.
  • Fees are billed on a recurring basis unless specified otherwise.
  • All payments are non-refundable except where required by law.
  • You authorize us and our payment processors to charge your selected payment method.

5. Free Trial

We may offer a free trial (e.g., 14 days). At the end of the trial, continued access requires a paid subscription. We may modify or terminate any trial at our discretion.

6. Intellectual Property

  • The Services (software, design, text, graphics, logos) are owned by OXYWEBS LLP or its licensors.
  • We grant you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes.
  • All trademarks, service marks, and logos remain the property of their respective owners.

7. Data & Privacy

  • Your use of the Services is subject to our Privacy Policy.
  • You retain ownership of your customer data; you grant us a license to process it to provide and improve the Services.
  • You are responsible for obtaining any necessary consents from your end users and for complying with applicable data protection laws.

8. Suspension & Termination

  • We may suspend or terminate access if you violate these Terms or pose risk to the platform or other users.
  • You may cancel at any time via your dashboard or by contacting support; cancellation takes effect at the end of your current billing period.
  • Upon termination, your right to use the Services ends and we may delete or anonymize your data in accordance with our retention policies.

9. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, OXYWEBS LLP and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to your use of the Services, even if we have been advised of the possibility of such damages. Our aggregate liability for all claims relating to the Services shall not exceed the amounts paid by you to us in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless OXYWEBS LLP, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services or violation of these Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction and venue of competent courts located in India.

13. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on adomatix.com. Your continued use of the Services after the effective date of the revised Terms constitutes acceptance.
